Terms & Conditions

1. Scope

The internet platform wingsforlife.com/en/my-fundraising-campaign is operated by Wings for Life – Spinal Cord Research Privatstiftung, a private foundation organized under the laws of Austria (FN 251592p). Wings for Life is a non-profit organization, according to which all funds are used exclusively for research purposes in accordance with the organisation’s articles of association. These terms and conditions apply to all registered users of wingsforlife.com/en/my-fundraising-campaign.

2. Registration

2.1. The use of the Wings for Life fundraising platform requires a one-off and cost-free registration.

2.2. The minimum age for registration is 14. Young people under the age of 18 should inform their parents before registering.

2.3. Users must be natural persons and are required to provide only accurate information, in particular with regards to their identity and age, when registering.

2.4. Wings for Life reserves the right to refuse registration without giving any reasons.

3. Duties and obligations of the user

3.1. Users are fully responsible for all content posted on wingsforlife.com/en/my-fundraising-campaign and its accuracy. Before posting content, users must confirm that their conduct or content will not breach regulations, moral expectations or legal rights (e.g. trademark law, naming right, copyright and data protection law, youth protection regulations). In particular, users undertake to obtain the required approval of participants/affected parties/beneficiaries, for example the photographers and the depicted or mentioned individuals, before uploading text and images and to provide Wings for Life with evidence of this at any time upon request. Users release Wings for Life from any third party claims arising from a breach of this obligation.

3.2. It is illegal to directly upload, provide links to or otherwise facilitate access to the following content on wingsforlife.com/en/my-fundraising-campaign:

  • Violent, pornographic or otherwise immoral content
  • Content that promotes or glorifies hate, violence or any form of discrimination
  • False statements of fact and offensive statements
  • Calls for boycotts or non-peaceful or otherwise illegal activity

3.3. If Wings for Life gains knowledge of prohibited content or suspects the existence of such content, Wings for Life is entitled to remove this content from the platform at any time.

3.4. If a fundraising campaign cannot be realized as initially planned, users are required to communicate this fact on the platform.

3.5. Passwords used to access wingsforlife.com/en/my-fundraising-campaign must be chosen in accordance with the general principles of password security and must be kept strictly confidential. Wings for Life must be informed immediately if users have reason to believe that the safety of wingsforlife.com/en/my-fundraising-campaign is compromised.

4. Rights of use

If users upload text, images, or other content to wingsforlife.com/en/my-fundraising-campaign, they grant Wings for Life the right to use such content on wingsforlife.com/en/my-fundraising-campaign or in promotional material for wingsforlife.com/en/my-fundraising-campaign, both on- and offline. Wings for Life is in particular entitled to change and save the content and make it publicly available on the platform, taking the original meaning into consideration. Distinct and clearly displayed alternative instructions when uploading the content remain unaffected.

5. Provision of Wings for Life fundraising platform

Wings for Life shall endeavour to keep the platform available and free of disruption whenever possible and aims for an availability rate of 97 per cent per year. Specific availability is not guaranteed. Wings for Life is in particular entitled to take the platform off the network, both for regular and unscheduled maintenance work. Wings for Life is entitled to change the functionality, appearance and other features of the platform as it chooses. Access to the platform is only provided for the current version. Wings for Life is not obliged to store or save versions or content on behalf of users.

6. Termination, suspension of access, deleting content

6.1. Usage as a registered user can be terminated by Wings for Life or the user at any time by submitting a notification in writing.

6.2. The right to extraordinary termination for good cause remains unaffected. Good cause for termination by Wings for Life in particular includes situations where users have significantly or repeatedly breached their obligations as defined in Clause 3 of this agreement or in the case of incorrect registration data.

6.3. Wings for Life is entitled to prevent the user from accessing individual or all functionalities of wingsforlife.com/en/my-fundraising-campaign, irrespective of the right to extraordinary termination. In particular, this prevention of access affects the option of uploading or amending content on wingsforlife.com/en/my-fundraising-campaign. Wings for Life is furthermore entitled to review, block or delete all content uploaded to wingsforlife.com/en/my-fundraising-campaign. Wings for Life shall in particular make use of this right if third parties report the violation of any laws, third party rights or the rules of Wings for Life show by specific content or users.

6.4. Prior to termination for good cause or the prevention of access by a user or blocking of content, the user shall have an opportunity to make a statement.

7. Liability

The liability of Wings for Life is excluded for all damages and liability claims, regardless of their legal grounds (e.g. defects liability, delay, impossibility of performance, breach of duty or tort), except for claims…

  • due to injury to life, body and health,
  • due to fraudulent intent or on the basis of a warranty,
  • due to wilful intent or grossly negligent conduct of Wings for Life or their legal representatives,
  • in accordance with the Product Liability Act. The legal regulations apply to these exceptions.

8. Data protection

8.1. Introduction

The privacy and responsible use of your data is very important to us and we always comply with the data protection regulations.

8.2. Collection and use of data Personal data that you provide to us when registering (e.g. your name and your contact details) are processed only in order to communicate with you, for internal analysis and only for the purpose for which you provided the data to us. We assure you that we will not otherwise disclose your personal data to any third parties, unless we are obliged to do so by law or you have given your explicit consent to this. Inasmuch as we use the services of third parties for the performance and handling of processing tasks, the regulations of the Data Protection Act 2000 shall be complied with.

8.3. Server log data When you visit our websites, the IP address currently used by your PC, date and time, browser type and operating system of your PC as well as the pages you visit will be recorded and saved temporarily. However, this information will not allow us to draw conclusions about your personal data and such conclusions are not intended, either. These so-called server log data must be saved for technical reasons and to ensure system security. The data are evaluated in anonymised form by the service provider contracted by us exclusively for statistical purposes and to improve the quality of our website. The server log data will not be linked to the personal data of any specific natural person. In particular, the server log data will not be merged with any other data sources.

8.4. Cookies To make our website more user-friendly and optimally tuned to your needs, we use cookies in some areas. “Cookies” are small text files that are saved locally on your computer’s hard disk, where they can be opened later to make use of our online offerings easier for you. We use cookies for the duration of your visit to our websites. The cookies are deleted automatically when you end your visit and close your Internet browser. The IP-address that your Browser conveys within the scope of Google Analytics will not be associated with any other data held by Google. 8.6. Social Plugin The internet platform wingsforlife.com/en/my-fundraising-campaign uses a social plugin (“Plugin”) from the social network facebook.com (“Facebook”). Facebook is a social network, operated by Facebook Inc. (1601 S. California Avenue, Palo Alto, CA 94304, USA). When you visit a page of our website that contains a Facebook Plugin, your browser establishes a direct connection to Facebook servers. Facebook directly transfers the Plugin content to your browser, which embeds the latter into the website, enabling Facebook to receive information about your having accessed the respective page of our website. Your rights If you no longer agree to the storage of your personal data, or your data have become incorrect, we shall arrange for the deletion, correction or blocking of your data as instructed within the scope of the statutory regulations. You may obtain free information about all your personal data that has been stored by us on request.
